1. Agreement
By accessing or using Chatple("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of service
Chatple helps streamers aggregate live chat from Twitch, YouTube, and Kick, manage overlays and alerts, and optionally receive tips through Chatple Rice balances funded via Stripe. Features may change, be added, or be removed over time.
3. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
4. Accounts and platform connections
You are responsible for maintaining the security of your account and for all activity under it. When you connect Twitch, Google/YouTube, or Kick, you authorize Chatpleto access the platform data and permissions you approve. You must comply with each platform's terms of service and developer policies.
5. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or abusive purposes
- Harass, threaten, or impersonate others through the Service
- Attempt to gain unauthorized access to accounts, systems, or data
- Interfere with or disrupt the Service or connected platforms
- Circumvent payment, tipping, or security mechanisms
- Scrape, reverse engineer, or misuse the Service except as permitted by law
6. Tips, rice balances, and payments
Tips are processed using Chatple Rice, an in-service balance unit. Viewers may top up rice through Stripe according to the rates shown in the product. Rice has no cash value outside the Service unless explicitly stated otherwise. We do not guarantee uninterrupted tipping or payment processing. Stripe's terms and privacy policy apply to payment transactions.
Streamers are responsible for complying with tax, disclosure, and platform rules related to tips and monetization in their jurisdiction.
7. Content
You retain ownership of content you submit, including tip messages, overlay settings, and chat messages sent through the Service. You grant us a limited license to host, process, display, and transmit that content solely to operate and improve the Service, including showing alerts on your stream overlays.
Chat and event content originating from third-party platforms remains subject to those platforms' rules and licenses.
8. Third-party services
The Service relies on third-party platforms and providers, including Twitch, YouTube, Kick, Stripe, GIPHY, and text-to-speech services. We are not responsible for third-party outages, policy changes, account restrictions, or data handling by those providers.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH EVERY PLATFORM FEATURE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHATPLE AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk for us or other users, or where required by law or connected platform policies. Sections that by nature should survive termination will continue to apply.
12. Changes to these Terms
We may update these Terms from time to time. If changes are material, we may provide notice through the Service. Continued use after the effective date of updated Terms constitutes acceptance.
13. Governing law
These Terms are governed by the laws applicable where the Service operator is established, without regard to conflict-of-law rules. Disputes will be handled in the courts of that jurisdiction, unless otherwise required by mandatory local law.
